I understand completely that if your state doesnt require a CDL for trailer axle weight then other states will honor that. In the lovely state of AZ, if your trailer axles have more than 10k on them you are REQUIRED to have a class A CDL. Axle rating has nothing to do with it. My pedestrian comment was something that nobody thinks about, just like you. To call that comment stupid just shows where your thoughts are. People do some stupid stuff to get a little money in the bank. If a person sees a truck like ours with a company name on it turning a corner slowly, they can stick a foot out there to get ran over and there you go, a lawsuit!!!! Is $1.20 a mile going to cover your butt for that? Say its stupid all you want, its your opinion and your entitled to it. You may not think its a part of your operating expense, UNTIL IT HAPPENS!! I hope you sell your equipment, just one less truck out there HAULING CHEAP CARS!!! Its pretty funny that you think that my comments are uneducated, and you are the one operating a truck for $1.20 a mile. I would be willing to bet you would run for under $1.00 a mile, huh? You said in another post you're on your 3rd tranny, bet that wasnt cheap, but your bank account just keeps growing? I make twice the money you make and yet I dont know how to run a business??? Cmon man. By the way, a buddy of mine showed intrest in your trailer on Ebay, and according to him you responded in an email that you occasionally run over weight, go figure!!!!
Keep on insulting me, I can take it. There are quite a few people that read this forum to get advice, and they need to see that running for $1.20 is not what the goal should be. Its guys like you that MISLEAD people wanting to get into the industry!!!! Your just anxious to sell a trailer, and as a result of that, you will tell people what ever they want to hear to make the deal.
There is so much false information in this post I simply do not have the time to correct it all. TO anyone reading this, do yourself a favor, go read the federal rules and understand that anytime you see a federal rule it over rides or supercedes the state ruled.. this joker is just trying to not look so bad by quoting rules that have nothing to do with the federal rules.. since there is no rule on a lane change state rules apply.. I think common sense is needed here but apparently some havent got it.
Let me reiterate: YOU DO NOT NEED A CDL IF YOUR TRAILER WEIGHS OVER 10k.. to say so is completely false when it comes to interstate commercial hauling. Its based on FEDERAL LAW and Arizona law does NOT apply. They can TRY and stop you but they cant LEGALLY because of the FEDERAL LAW.
I'd quote the law right now, but I think anyone actually interested should learn how to find it so you know what all the other rules are and this joker doesnt make you do something you regret. But again, its based on GCVWR. PERIOD end of story. I can't tell you how many weigh stations Ive been thru that would have put me out of service if this guy were right. And they no damn well what my weight is because they charge me tax when I am above 26001 and sometimes 18k.. cant remember all the states.. they CAN charge you whatever the hell they want for tax.. but not enforce state laws..
Honestly, I dont give a rats ass if I sell my trailer.. its nothing to me... so for him to comment that that is why I am saying this is just stupid. I made my money on tax write offs.. lol.. needed the tax break..
Also, another suggestion: do what I did.. call the state patrol in the state you are planning to operate in. Ask them the question.. BUT be CAREFUL... thus this little funny story:
I was personally driving my rig thru washington. Crossed the line at 3am and hit a weigh station. Sign said all commercial trucks so I pulled in.. I was loaded up with 2 good size suvs and an old 1940's ford pickup and was at 26,500 and some add pounds. I was pulled in for a full inspection (my first one, i was scared to death).. the officer was a real a$$... which sometimes happens.. he went thru my logs and thru my truck and trailer.. (asked if I could back up my rig, I just rolled my eyes).. bitched cuz my fire extinguisher came loose.. and then told me I was done driving because I do not have a CDL. I did all my homework but I still about wet myself. There was another officer right there and I said to both of them that I had read the rules and I do not need one. Both of them laughed at me. Then one printed out the rules and read them to me.. when he go half way thru he slowed... he looked at his buddy and didnt say a word. Then his buddy said, alright, Ill tell you how we do this.. we have a flow chart.. and he pullled it out.. its one of those yes/no charts.. like, truck weighs over 26000 lbs yes or no and then you go to the next section based on the answer.. truck and trailer combined have a GCVWR of 26001 or more.... ooops.... NO.. so it sends you down to NO CDL NEEDED.
He turned to his buddy and said, I'll be damned, he is right. LOL.. I was shaking at this point. He signed me off and I was on my way. I pulled over at the next stop and layed down to slow my breathing.. lol.. He almost wrote me up for my fire extingusher being loose too.. what a joker... and it was still in its strap! just the strap was undone.
So ever since then I knew that I needed to educate the state patrol.. I wish however I knew about the window tint laws.. LOL.. got nailed 2 times for that and then tore it off.
Anyway... truth be told, I dont need to sell my trailer.. I needed the tax write off.. paid for it 3 times. If someone wants it, so be it.. if not I'll find someone I can trust again and when the central dispatch (wow back on subject!) auction is over I'll get back in the game. Or maybe I can play it smart and get off of CD.. I just never got the contacts needed.. they are out there.. I am sure anyone moving better than 1.20 a mile has them. CD is nothing but an auction right now.. its sad.. getting cars picked up on time and delivered on time means nothing anymore apparently. We were never late once and never even scratched a car but I could never get someone to work with me exclusive.. just a drag.
Probably my last post here.. because Junior is gonna be real annoyed with me now.. lol.. so not interested in a pi$$ing match and have better things to do.. good luck everyone.
